BP to face day in court over Gulf of Mexico oil spill

NEW ORLEANS (Reuters) - Nearly three years after a deepwater well rupture killed 11 men, sank a rig and spewed 4 million barrels of oil into the Gulf of Mexico, BP and the other companies involved are about to face their day in court.

The trial over the worst U.S. offshore oil spill is set to start this morning in New Orleans before a federal judge and without a jury. Few expect the case, seen lasting several months, will be decided by the judge.

Efforts to pull together an eleventh-hour settlement over the weekend did not result in a deal, but legal experts expect a resolution, at least with the U.S. Department of Justice, in the coming months. Early testimony is likely to set the tone for any settlement talks, depending on how damaging the evidence is, the experts said.

"This is a game of corporate chicken," said John Zavitsanos, a Houston civil litigator. "We have tangled with BP often, and they blink."

Joining well owner BP Plc in Judge Carl Barbier's courtroom will be rig owner Transocean Ltd and well cement services provider Halliburton Co .

Lined up against them will be the Justice Department, several Gulf Coast states and other plaintiffs.

BP has a history of settling civil cases before or during trial. Four trials began over the 2005 explosion at its Texas City refinery that killed 15 people. All were settled. Payouts totaled $3.1 billion. BP has since sold the refinery.

The stakes are higher this time, though. The Macondo well explosion and spill on April 20, 2010, affected five state coastlines, prompted a six-month ban on oil and gas drilling in the Gulf, and disrupted the livelihoods of fishermen, hoteliers and others.

BP has spent or committed $37 billion on cleanup, restoration, payouts, settlements and fines. That includes $8.5 billion to most plaintiffs, a record $4.5 billion in penalties, and a guilty plea to 14 criminal counts to resolve criminal charges from the Justice Department and civil claims from the U.S. Securities and Exchange Commission.

The company has sold $38 billion in assets to help cover its spill-related costs, including its older, smaller Gulf of Mexico operations.

But the company could end up paying tens of billions more, depending on whether the U.S. government, Gulf states and plaintiffs convince Judge Barbier that BP was grossly negligent.

Simple negligence involves mistakes. Gross negligence involves reckless or willful disregard for human and environmental safety and is a difficult standard to prove, experts say.

A finding of gross negligence would open the door to punitive damages against BP, Transocean and Halliburton.

The first phase of the trial, expected to last several months, will focus on the level of negligence as well as apportion blame between the defendants.

The second phase, slated for September, will focus on the flow rate of the oil that spewed from the well. The third phase in 2014 will consider damages.

(AP) ? President Barack Obama will be meeting with the nation's governors as they push Congress to avert deep federal spending cuts that begin to take effect Friday.

The state leaders are in Washington for the annual meeting of the National Governors Association. The president, first lady Michelle Obama, Vice President Joe Biden and his wife, Jill, are scheduled to address them at the White House.

Obama administration officials warn of significant airport delays, deep cuts to education and furloughs for hundreds of thousands of government workers if the budget cuts go through, as widely expected.

The president did not mention the budget stalemate during a White House dinner with most of the governors Sunday night. But Obama told them, "We've got more work to do."

Last year, the NFL stripped $36 million in cap space from the Redskins, who along with the Cowboys apparently took the term ?uncapped year? too literally in 2010.

In response, the Redskins employed half-measures to recover the cap dollars, filing a grievance under the labor deal that did nothing other than stir up a cockeyed collusion claim from the NFLPA.

This year, with half of the penalty due to hit the 2013 salary cap, the Redskins could be opting for a more complete assault on the league?s position.? Or at least threatening it.

According to Mark Maske and Mike Jones of the Washington Post, the Redskins are spreading the word in Indianapolis that they?re considering legal action aimed at delaying the start of free agency while litigation proceeds regarding the question of whether the Redskins? legal rights were violated.? The Redskins are telling agents that any contract talks will be delayed until the situation is resolved.

If the Redskins proceed, it would be a big deal.? And if they delay the start of free agency until their claims are resolved, it would be a huge deal.

We addressed the situation a couple of weeks ago, reporting that the Redskins were still upset about the situation but explaining that their options are limited.? They could bebluffing about going to court in order to get, for example, half of their cap money back (i.e., the $18 million that would apply to this year?s cap).? But the NFL could choose to call their bluff and go to court.

Either way, Daniel Snyder could be inching toward ground previously occupied by the late Al Davis:? Snyder could soon be suing his partners.

Think Nokia's all about Lumias these days? While the Windows Phone brand is still the company's primary point of focus, it doesn't mean Nokia isn't still cranking out millions of basic phones for emerging markets around the globe. With that in mind, the Finnish phone giant has outed two such handsets at its event at Mobile World Congress. Sure, they aren't much to look at, but Nokia feels it's still an important element of its strategy to dominate the lower-end market segment.

The first cellular telephone unveiled at this morning's event is the Nokia 105, which is about as simple as they come these days. Once it arrives on the market this quarter, you'll be able to grab one for €15 ($20) in either cyan or black. It contains such features as a flashlight and FM radio, and the noteworthy bullet point is its month-long battery life (standby time). The second half of the pair is the 301 (pictured above), which is a bit more fancy at €65 ($85). It will come with a 3.2MP camera with panorama mode, sequential shots and a clever little self-portrait mode that audibly prepares you for your next glamour selfie. Additionally, the 301 lets you take advantage of Mail for exchange, Nokia Xpress internet (which compresses data down by about 90 percent) and HSPA connectivity with video sharing. Dual and single-SIM options will be available in Q2 of this year.
